Article 1 — Website publisher

The website naked-underwear.com (the “Site”) is published by MLPR, a French simplified joint-stock company (SAS) with a share capital of €1,000, registered with the Rouen Trade and Companies Register under number 908 188 675, with its registered office at 2 rue Beauvoisine, 76000 Rouen, France. EU VAT number: FR64908188675. The company operates the NAKED Underwear brand.

Article 2 — Publication director

The publication director is Mathis Le Provost, President of MLPR.

Article 3 — Hosting

The Site is hosted by Shopify Inc., 151 O’Connor Street, Ottawa, Ontario K2P 2L8, Canada, which provides the e-commerce platform. The domain name and email services are managed by OVH SAS, 2 rue Kellermann, 59100 Roubaix, France.

Article 4 — Intellectual property

All elements of the Site (graphics, images, texts, videos, animations, sounds, logos, icons and their layout) are the exclusive property of MLPR, except for trademarks, logos or content belonging to partners or third-party authors.

Any reproduction, distribution, modification, adaptation, retransmission or publication, even partial, of these elements is prohibited without the express written consent of MLPR. Any unauthorised use constitutes an infringement punishable under articles L.335-2 et seq. of the French Intellectual Property Code.

Article 5 — Site content and liability

MLPR strives to provide information on the Site that is as accurate as possible and to update it regularly. The information is not exhaustive, photographs are not contractual and everything may change without notice.

If you notice an error, an omission or a malfunction, please report it to contact@naked-underwear.com, describing the problem (page concerned, device and browser used).

Any content downloaded from the Site is downloaded under the user’s sole responsibility. MLPR cannot be held liable for damage to the user’s equipment or for any loss of data resulting from a download. The user undertakes to access the Site with recent, virus-free equipment and an up-to-date browser.

Article 6 — Hyperlinks

The Site may contain links to other websites or resources. MLPR does not control these sites, does not guarantee their availability or content, and cannot be held liable for any damage resulting from consulting or using them. Placing a link to the Site requires MLPR’s prior authorisation, to be requested at contact@naked-underwear.com; MLPR may accept or refuse without giving reasons.

Article 7 — Cookies

The Site uses cookies and similar technologies for its operation, audience measurement and, with your consent, personalisation and advertising. A cookie is a text file placed on your device by the server of the site you visit. You can accept, refuse or configure cookies at any time from the Site’s consent banner. Some features may require cookies to be accepted.

Article 8 — Personal data

You are not required to provide personal data to browse the Site. Some services (ordering, creating an account, contact form, newsletter) do however require data such as your name, address, email address and phone number.

How your data is collected, used and retained, as well as your rights (access, rectification, erasure, objection, restriction, portability), are described in our privacy policy. You can exercise your rights by writing to contact@naked-underwear.com.

Article 9 — Consumer mediation

In accordance with articles L.616-1 and R.616-1 of the French Consumer Code, MLPR has set up a consumer mediation scheme. If you have not obtained satisfaction after sending us a dated written complaint (letter or email) setting out the facts and your request, and if you have received a negative answer or no answer within two months, you may refer the matter free of charge to the mediator:
